i'm looking at filing a lawsuit in small claims court, i was wondering if anyone could give me a professional opinion as to what my chances of winning the case are.

its only over $100, so paying for an actual consultation would be dumb... i'm just looking for someone to answer a couple questions.

i went there last night, her parents werent home (****ty coincidence... they were at her sisters college graduation)... she let me in, and then instigated an argument, started calling me immature etc (lol). her douchebag boyfriend chased me out of the house... i closed the door in his face, it broke (glass storm door). he chased me down the street on my moped yelling threats, etc (damn thing doesnt always start immediately lol)

so when i got home she had her ****ing aunt calling me (her moms twin sister) posing as her mom. bitching and yelling about the broken door. when i brought up the lawsuit and the money her daughter owed me (etc) she admitted that she wasnt REALLY her mom, and that her mom would call me tomorrow (today). havent heard from her yet.

the girl told me later in the night via text that she'll pay me by next thursday, if she doesnt... lawsuit time. i'm pretty sure someone saying they will pay you is proof that an agreement existed... and i dont think you can fake a text unless you stole her phone lol.

at my new years party (early on in the night, no one was wasted yet) i lent her $100... she had just lost her job and needed to pay her car payment. she agreed to pay me back immediately upon finding a new job. shes been working for a while now.. no money.

there were like 8 people there when i lent her the money, i have at least two who are willing to testify that they were witnesses to the agreement. i made it REALLY obvious in a somewhat joking way at the time... like "OKAY everyone! i'm lending ashley $100! just want you all to see just in case she decides not to pay me back"

it is now almost june and i havent seen a dime. i have several logged IM conversations (logged automatically on google, so they cant be tampered with by anyone... not sure if thats admissible or not) in which we discuss the debt, and then she told me at one point ~3 weeks ago that she was never paying me back my $100. thats when i started looking into small claims.

again that is why i tend to stay away from chicks... they are only good for one thing and that isn't a long term relationship for sure.... get your fun then get out man... and don't lend money to them
